The agreement between you and TUC Now for using TucDesk.

Definitions

"Service" means TucDesk Cloud and the TucDesk-distributed software, including the dashboard, API, rendezvous, relay infrastructure, and client applications. "User" means any person or organization with a TucDesk account. "Operator" means a User who connects to and controls remote machines through the Service. "Agent" means the TucDesk software installed on a machine to make it reachable through the Service. "Team" means a workspace of Users sharing agents, roles, and policy under a single organization boundary.

By creating an account, installing an Agent, or using the Service, you agree to these terms. If you use TucDesk on behalf of an organization, you represent that you have authority to bind that organization.

Acceptable use

You may not use the Service to conduct attacks against networks or systems, to host, transmit, or distribute illegal content, or to access systems without authorization. Research and testing must be conducted only against systems you own or have explicit permission to test.

You may not attempt to bypass consent gates, audit logging, policy ACLs, rate limits, authentication controls, or tenant boundaries. See the Acceptable Use Policy for the full list of prohibited activities.

Service availability

Paid plans carry a 99.9% monthly uptime SLA for TucDesk Cloud. The free tier is provided on a best-effort basis with no availability commitment. Scheduled maintenance, security releases, abuse mitigation, and upstream provider incidents are handled under the SLA terms of your plan.

Self-hosted uptime is controlled by the operator. TucDesk provides software artifacts and documentation, but the operator is responsible for capacity planning, monitoring, backups, and disaster recovery.

Security responsibilities

You are responsible for protecting your account credentials, rotating secrets, and controlling who can access your operators, agents, and recordings. You must promptly remove access for operators who no longer need it.

You are responsible for ensuring that every Agent deployment is authorized — Agents may only be installed on machines you own or are explicitly authorized to manage. TucDesk provides end-to-end encryption, signed audit logs, and role-based access control, but these controls do not replace your own operational security.

Billing

Paid plans are billed monthly or annually and renew until canceled. Upgrades take effect immediately and are prorated for the remainder of the billing period. Downgrades and cancellations take effect at the end of the current billing period; we do not issue refunds for partial months.

Fees depend on the selected plan, usage, storage, and any enterprise agreement. Self-hosted infrastructure can be run without Cloud billing unless you separately purchase managed hosting, enterprise support, or a commercial license.

Termination

Either party may terminate with 30 days notice. You may stop using TucDesk Cloud at any time; after termination you remain responsible for exporting or deleting your own data within the retention window.

We may suspend or terminate access immediately, without notice, for abuse: violations of the Acceptable Use Policy, activity that creates security risk for other customers, non-payment, or use of the Service to harm third-party infrastructure.

Limitation of liability

The Service is provided as-is except where a signed enterprise agreement or applicable law requires otherwise. Remote infrastructure tools can affect critical systems; production use requires appropriate backups, least-privilege access, staged rollout, and monitoring.

To the maximum extent permitted by law, TucDesk is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption. Our aggregate liability under these terms is limited to the amounts you paid for the Service in the twelve months preceding the claim.
